I plan to sub-contract the work to a company that is insured, and has all the propper documentation. I was curious if it is legal to do this in my state (MA)

No. Contractors, even those who subcontract every part of a job, have to be licensed and bonded. If you will be getting paid you will also need a business license.

We hired a home improvement contractor for a major landscaping job. He completed about 80% of the work but then disappeared. Right before he disappeared, he asked if we minded paying him for the work he already completed. He seemed nice so we agreed. Then, he vanished, even though he signed a contract with us saying that he was supposed to do our driveway (which he didn’t — and now it is near winter and we have no driveway). Can he legally do this? (walk off a job even though the work in the contract is incomplete)

No its not legal but very common. Small claims court, you pay to start the lawsuit, alot of costs involved. Is he a licensed contractor? Turn him in to the office in your local area. Is he an illegal contractor, meaning no business license, watch for his truck, and call the cops if you see him and see if they will come. Or approach him and tell him your calling the cops on your cell right now, if he doesn’t give you cash immediately. This is a very common and hard to get satisfaction type of situation I hear about all the time. Never pay in advance more than agreed to. If hes bad with money, that’s his problem.
